Relation Central Utah Project; Western Waters Digital Library; the draft FA concluded that the changes in the lake fork river stream flows caused by project operation operationwould would not affect the ute ladies tresses orchid spiranthes dilu diluvialist dilwiaus diluvialis vialis vialls we concur with that conclusion your letter of ofjune june 152001 15 2001 stated that you expect that construction of the diversion structure on the lake fork river may affect plants located there the EA states that surveys prior to construction will be conducted during the flowering period to determine if the orchid is present to tlle the tile extent practicable and consistent with the goals of minimizing impacts to the lake fork river from location of the diversion and also minimizing future operation and maintenance requirements the diversion structure and associated pipeline will be located to avoid impacts to orc ore orchids bids however there is a risk that impacts to orchids will be tin xin unavoidable avoidable with proper siting and construction of the diversion structure As a conservation measure the district in a letter dated july 3 32001 2001 has committed to contributing toward completion of an agency and public review draft status report of the ute ladies tresses orchid the status review report compiles information necessary to evaluate eligibility of the orchid for de listing or failing to find that de listing is warranted identification and prioritization of actions necessary to accomplish recovery A preliminary status review report has been prepared by the fish pish and wildlife service but incorporation of information from the 2000 field season and additional editing are required in order to complete an agency and public review draft based on the me districts efforts to survey for and avoid impacts to the orchid to the extent practicable and involvement in completing a draft status review report we concur that the project may affect but is not likely to affect ute ladies tresses orchid this concludes section 7 consultation for this project should project plans change or if additional information on the distribution of listed or proposed species becomes available these determinations may be reconsidered we appreciate the districts commitment to conserve and protect federally listed species we vve also appreciate efforts to design a water development project that minimizes environmental impacts while providing environmental benefits such as aq augmenting certain instream instrearn in stream flows and stabilizing wilderness high mountain lakes if we can be of offurther of further assistance please contact dr lucy jordan fordan at the letterhead address or telephone 801 5245001 524 5001 ext 143 sincerely vhcnry enry R maddux field supervisor cc DOI CUP completion act office anttn attn ron johnston program director B 6
