Relation Central Utah Project; Western Waters Digital Library; attachment F COMMENTS AND RESPONSES ON THE DRAFT supplement TO THE FINAL environmental STATEMENT of utah appealed the judgment to the tenth circuit court of appeals on september 14 1980 the circuit court affirmed the trial court decision on december 1 1980 A programmatic type EIS was completed f foc for or the entire bonneville unit in 1973 this EIS was f final inal finai inai for only the strawberry aqueduct and collection system environmental impact statements have been or are being prepared f foc for or the remaining three systems of the bonneville unit which include site specific impact analyses of each feature within the system the final EIS for the municipal and industrial system was com pleted plated in 1979 the various systems and interrelationships of the bonneville unit are described in the 1979 FES issue 81 the draft statement specifically fails to address the requirements of executive order no 11988 floodplain Flood plain management there is no mention of any action by the bureau which would comply with this order see letter 22 response the basic requirements of executive order 11988 have been met and documented in the bonneville unit definite plan report 1964 the mai m&i summary statement 1979 in the 1979 FES and in this supplement the primary purpose of the executive order is to avoid to the extent possible the long and short term adverse impacts associated with use and modification of flood plains and to avoid flood plain development wherever there are practicable alternatives the FES and the supplement present an analysis of alternatives showing that to achieve project purposes there is no practicable alternative other than to construct jordanelle Jor danelle reservoir in the flood plain of the provo river analyses showed that project benefits cannot be obtained by either carrying out proposed plans outside of the flood plain or by employing means other than construction of a dam and reservoir A no action act ion lon alternative was also evaluated the FES and the supplement also document the construction and operation environmental commitments that will be implemented to minimize adverse impacts to the flood plain the presence of the reservoir will also provide storage that will reduce down downe stream damage from floods public involvement requirements of the executive order were accomplished in concert with the NEPA process these efforts are described in chapter IV of the text the basic objective of the reclamation program is the development and conservation of water and related land resources to the extent practical reclamation will integrate flood plain management requirements into its planning construction and operation decision processes pro posed projects are evaluated to determine where alternatives to flood plain development exist issue 82 neither the FES nor the draft supplement contains an estimate of the loss of life destruction or damages that would occur in the event of a dam failure see letter 22 184
