Relation Central Utah Project; Western Waters Digital Library; comment letter no 11 operating agreement constitute a contract to indemnify the strawberry valley projectfrom project prom from the requirements of the endangered species act furthermore title 6 of ofcupca CUPCA specifically states that neither ESA nor NEPA are modified by the legislation in addition see comment response 11.1 111 ili ill regarding the 1991 contract COMMENT 11.23 1123 the 1991 contract satisfies any requirements of 209 of CUPCA and is functioning adequately the 1991 contract is a permanent division of the water supplies and capabilities to be available to the SVP and CUP in the enlarged strawberry reservoir and diamond fork system under their respective rights to the use of facilities the 1991 contract is not an interim agreement but is a permanent agreement and needs no modification the DEIS operation studies do not model reservoir operations under this permanent division of rights to the use of facilities the DEIS is therefore flawed and inadequate in this respect and should be updated with appropriate studies to reflect operations of the reservoir under the permanent 1991 contract RESPONSE 11.23 1123 please see comment response 111 regarding the 1991 contract further discussion regarding the requirements of section 209 of CUPCA will be addressed and clarified when the planning and NEPA process associated with the utah lake drainage basin water delivery system is underway COMMENT 11.24 1124 the 1991 contract provides a firm SVP water supply of 61000 AF plus the banked storage of SVP storage each and every year the DEIS operation studies provide a variable water supply of a yearly average of 61500 AF for the SVP and does not evaluate operation of the project to deliver a firm 61000 AF plus the banked storage of SVP storage water to SWUA the SWUA has repeatedly requested that the SFN operation studies incorporate the operating criteria of the 1991 contract the DEIS must be revised to include the firm annual allocation 61000 AF to the SWUA each and every year with a 50000 AF storage allocation in the enlarged strawberry reservoir to provide operational flexibility for delivery of mis this mls uis firm 61000 1000 6 AF plus the banked storage as provided in the 1991 contract RESPONSE 11.24 1124 the 50000 acre feet of storage space in strawberry reservoir only recognizes what is necessary to provide strawberry valley project with their average 61500 acre feet and does not expand their water availability in strawberry reservoir the impacts associated with the conveyance of SVP water through the diamond fork system facilities is included and addressed in this FSFEIS FS FEIS fels and result in environmental benefits in addition see comment response 11.1 111 ill iii regarding the 1991 contract COMMENT 11.25 1125 the descriptions of the MCAPWDFT MCAPW DFT pa p pigi p1 19 1 9 91 1 and the MCAT pa p p1 1130 1 130 alternatives in the DEIS do not specify the maximum cfs cs capacity of the diamond fork turnout for release of SVP storage water into the spanish fork river at its confluence with diamond fork creek that failure constitutes a serious flaw in the DEIS since the impacts of release capacity must be addressed in addition to the impacts of release quantity the diamond fork turnout capacity must be specified in the DEIS for these alternatives and must have sufficient capacity to provide 600 cfs cs combined SVP delivery capacity to the spanish fork river RESPONSE 11.25 1125 please see comment responses 11.13 1113 and 11.14 1114 4 427 1 27 7 diamond fork system FSFEIS FS FEIS
