The Compact is not a grant of rights to the upper basin, but a ceiling on the appropriations in both basins. The basins are free to appropriate any quantity of unappropriated water up to their respective ceilings. Such was the decision of the Special Master: "Article II of the Compact divides the entire Colorado River Basin into Upper and Lower Basins, and Article III (a) and (b) apportions the use of water between the two Basins and not among states.
